Terms of Use

These Terms of Use ("Terms") govern your access to and use of the SpyPlates mobile application and the spyplates.com website (together, the "Service"), operated by GVX Digital LLC ("we," "us," or "GVX Digital"). Please read them carefully.

Safety first. SpyPlates is a game for passengers or for use while safely parked. Never operate a mobile device while driving. The mission can wait — arrive safely.

1. Acceptance of these Terms

By downloading, installing, or using SpyPlates, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you are using SpyPlates on behalf of a minor, you accept these Terms on their behalf and are responsible for their use.

2. Safety and distracted driving

Your safety and the safety of others always comes first. By using SpyPlates, you acknowledge and agree that:

  • SpyPlates is intended for use by passengers, or by a driver only when the vehicle is safely and legally parked.
  • You will never operate, view, or interact with the app while driving or otherwise operating a vehicle.
  • You will obey all applicable traffic, distracted-driving, and mobile-device laws in your jurisdiction at all times.
  • You will not encourage or permit a driver to use the app while driving.

You are solely responsible for using the Service safely and lawfully. We are not responsible for any injury, loss, or damage resulting from use of the Service while driving or in any unsafe manner.

3. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use SpyPlates for your own non-commercial entertainment on a device you own or control. This license is also subject to the Apple App Store Terms of Service, including the Licensed Application End User License Agreement (EULA), where applicable.

4. Acceptable use

SpyPlates is a collection game and travel companion. It is not a law-enforcement tool, surveillance product, license-plate database, or automated license plate recognition (ALPR) platform, and you agree not to use or represent it as such. You agree that you will not:

  • Use the Service to harass, surveil, track, identify, or target any person or vehicle.
  • Attempt to record, infer, or store license plate numbers or personal information about others through the Service.
  • Reverse engineer, decompile, modify, or create derivative works of the Service, except where permitted by law.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems.

5. Your responsibility

You are responsible for your own conduct while using SpyPlates and for compliance with these Terms and all applicable laws. You are responsible for the device you use, for keeping your device and any backups secure, and for any consequences of how and where you choose to use the Service. SpyPlates does not supervise, control, or take responsibility for travel decisions, routes, or activities undertaken while using the app.

6. Intellectual property

The Service, including its software, design, text, graphics, "Atlas Intelligence" content, characters, logos, and all related materials, is owned by GVX Digital LLC or its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. You may not copy, distribute, or exploit any part of the Service without our prior written permission.

7. Purchases and pricing

SpyPlates is free to download and play its core experience. Any optional in-app purchases or future premium content are processed by Apple through the App Store and are subject to Apple's terms and refund policies. Prices and availability of optional content may change. Purchases are non-refundable except as required by law or by Apple's policies.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Any content within the Service, including "Atlas Intelligence," Highway Legends, and similar material, is fictional and provided for entertainment only.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GVX DIGITAL LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

This includes, without limitation, any damages arising from use of the Service while driving or in any unsafe manner, which is expressly prohibited. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $10.00.

10. Indemnification

You agree to indemnify and hold harmless GVX Digital LLC and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky and applicable U.S. federal law, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Kentucky, except where prohibited by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide notice within the app or on this website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
